trailab limited is a private limited company registered in Scotland, with the company number SC377875, and registered office address at Suite 117, 36 Washington Street, Glasgow, G3 8AZ. In the following text, ‘we’ are the company trailab limited and ‘you’ are the lead name on the booking.
You must have the legal capacity and authority to book as the lead name and accept these Terms and Conditions on behalf of your group. When you book, we will send you a confirmation invoice which will describe your booking, at which point a contract will exist between us. Please tell us immediately if any detail on the confirmation invoice is not correct. We reserve the right to correct any error as soon as we become aware of it, but should any change not be acceptable to you, you will be entitled to a refund as detailed below. By asking us to confirm your booking, you are accepting that these Terms and Conditions constitute the entire agreement between us. Your contract with us shall be governed by and construed in accordance with the law of Scotland.
Paying for your booking
We reserve the right to change any of our prices from time to time prior to booking, but we will not increase the price once a booking is made. If you are booking more than 4 weeks ahead of your arrival, we will accept 50% of the total price as a deposit to confirm your booking. If you are booking less than 4 weeks ahead of your arrival, you will be required to pay 100% of the total price before we can confirm your booking. All bookings must be fully paid 4 weeks prior to your arrival. If you do not pay either the deposit or full amount by the relevant date, we reserve the right to cancel your booking with no refund or further notice. Upon request, we will make purchases on your behalf both before and during your holiday. To enable us to do so, credit card details will be held as a guarantee or a prepayment amount will need to be made. Please note that any such purchases must be settled in full prior to your departure.
If we change or cancel your booking
We reserve the right to change or cancel your booking in any circumstances but if we cancel your booking you will either be offered a full refund or the chance to accept a replacement date of equivalent price (if one is available). We will always refund the difference in price if the replacement date is at a lower price. We will not cancel your booking less than 4 weeks before the start of your stay, unless you fail to pay the balance on your booking, or should an event beyond our control make it necessary to do so. We accept no liability for any further costs incurred by you as a result.
If you change or cancel your booking
Once we receive written notice of your wish to cancel, you should expect to receive a cancellation invoice from us within one week. To cover the cost of processing your cancellation and to compensate us for the risk that we may not be able to resell the dates of your booking, we reserve the right to charge as follows:

We will only offer a 100% refund in circumstances due to causes beyond our control, if we cancel or, at our absolute discretion, we agree to cancel the booking. For this reason, we recommend that you take out travel insurance and ensure that this risk is covered (go to Money Supermarket for more details).
If your booking changes because someone in your party cancels, we will recalculate your booking cost based on the new number of people staying. If fewer people share the accommodation, then the cost for them may go up. This extra cost is not a cancellation charge, and it is not covered by our insurance. We reserve the right to consider all dishonoured cheques or fraudulent payments as a cancellation.
The accommodation must only be used by those people named on your confirmation invoice (or on any amendment invoice issued). You are not allowed to share the accommodation or let anyone else stay there.
You must take all reasonable care of the accommodation and leave its furniture, pictures, fittings and effects in the same clean and tidy condition at the end of your stay as at the beginning. You are responsible for the cost of any damage caused to your accommodation or its contents during your stay.
You cannot bring pets to the accommodation unless we have expressly agreed in advance (for example in the case of registered guide dogs). If you bring pets without our permission, we reserve the right to stop everyone in your group entering the accommodation or ask you to leave.
You must give us or our representative access to the accommodation at any reasonable time while you are staying there to carry out essential maintenance or if there is an emergency. Wherever possible we would arrange this in advance.
By booking with us you undertake that you have, or will put in place prior to your holiday, appropriate travel insurance to cover you in all circumstances for the duration of your stay and for all activities in which you intend to participate. Any such policy should cover accidental damage to the accommodation, activity participation, personal items, medical expenses, the cost of repatriation in the event of illness and cancellation by you. No liability will be accepted by us if you travel without adequate insurance. You must carry proof of insurance with you on your stay. Clients are wholly responsible for arranging their own insurance and should ensure that there are no exclusion clauses in their policy of insurance limiting protection for the type of activities included in their holidays. Whilst we may provide tools and general advice, you remain personally responsible for the maintenance and working order of any equipment that you bring on your holiday.
We reserve the right to refuse to accept you as a customer or continue dealing with you if your behaviour is disruptive or affects other guests or is threatening or abusive towards us or our partners, on the telephone, in writing or in person. In any of these circumstances you may be evicted from the accommodation and no refunds will be paid to you and we may make a claim against you for any costs and expenses incurred as a result of your behaviour. Criminal proceedings may also be instigated. Reference to “you” or “your” includes for the purposes of this section the conduct also of any other person in your group.
It is your responsibility to ensure that you are sufficiently fit and adequately equipped to partake in your chosen holiday. You are advised to tell us of any medical conditions or dietary requirements at the time of booking.
In no event will we be liable to you, in contract, delict (including negligence or breach of statutory duty) or otherwise howsoever and whatever the cause thereof for any loss of profit, business, contracts, revenues or anticipated savings, increased costs or expenses, special, indirect or consequential damage or loss howsoever arising out of a booking.
If you intend to participate in any activity along with us, you hereby accept and acknowledge that you do so entirely at your own risk and that we do not have professional guiding, teaching, mechanical or first aid qualifications. All activity holidays involve an element of risk and it is your responsibility to act with due care at all times. Where excursions or services such as mountain biking lessons are provided by another company, even where such excursions or services are sold or recommended by any of our representatives, we will have no liability for these services.
Our total liability to you in respect of any costs or losses directly associated with any booking shall in no circumstances exceed an amount equal to the total sums paid by you to us in relation to that booking. Nothing in these Terms and Conditions shall seek to limit or exclude our liability to you for death or personal injury caused by our negligence.
If you have a problem with your booking, you should contact us straight away and we will endeavour to assist. If you are still not satisfied, you must write to us at the address given on our website within 3 weeks of your departure to allow your problem to be investigated properly. If you do not give us the opportunity to resolve a problem at the time, then we may not be able to deal positively with any problem that you make to us in writing.
Please note that when giving information for the purposes of making your booking, you will be deemed to consent to us holding, using and making that information available to any subcontractor for the purposes of making a booking on your behalf and subsequently meeting our obligations set out in these Terms and Conditions.
